What Happens After You Respond (Landlords)
Acknowledgment of Response
On receipt of a response, the Tribunal will carry out an initial check to confirm that:
- the required information has been provided; and
- the response has been submitted within the applicable time limit.
If these requirements appear to be met, receipt will be confirmed in writing.
If information is missing or unclear, the Tribunal may contact the respondent to request further details before deciding whether the response is compliant and can be taken into account.
Compliance of Responses
For your response to be considered, it must meet the Tribunal’s procedural requirements.
The Tribunal may:
- reject all or part of a response if it does not comply; or
- ask the landlord to provide further information so that the response can be treated as compliant.
If a response is rejected, the landlord will be informed in writing and given reasons for the decision, along with information on how to request reconsideration.
The landlord has the same right as the tenant to ask for reconsideration of a decision to reject a response.
The reconsideration will be carried out by a different person from the one who made the original decision.
Rejection and Reconsideration
If a response is rejected, written notice will be provided setting out:
- what has been rejected
- the reasons for the decision
- how to request reconsideration.
A request for reconsideration must be made within 21 days.
The reconsideration will be carried out by a different person from the original decision-maker.
Sharing of Information With the Appellant
The Tribunal will share the response with the tenant.
Any evidence provided will also be shared so that both parties have a fair opportunity to consider and respond.
Further information or evidence submitted during the process will normally be shared with both parties.
What Happens Next
The Tribunal will consider the response together with the application and all supporting evidence.
If no response is submitted, the Tribunal may proceed and make a decision based on the information available.
