What Happens After You Appeal (Tenants)

Acknowledgement of Application

On receipt of an application, the Tribunal will carry out an initial check to confirm that:

  • the required information has been provided; and
  • the application has been submitted within the applicable time limit.

If these requirements appear to be met, receipt will be confirmed in writing.

If information is missing or unclear, the Tribunal may contact the applicant to request further details before deciding whether the application is compliant and can proceed.

What “Compliant” Means

An application is compliant if:

  • it falls within the Tribunal’s jurisdiction
  • it contains sufficient information to determine the issue
  • it is submitted within the applicable time limit (or any extension granted)
  • it has not been withdrawn.

The Chair or the Secretary may review compliance at any stage.

If an application is incomplete or unclear, further information may be requested before a decision on compliance is made.

Only the Chair may decide that an application is not compliant on jurisdictional grounds.

Rejection and Reconsideration of Applications

If an application is not compliant, it may be rejected. Written notice will be provided setting out:

  • that the application has been rejected
  • the reasons for the decision
  • how to request reconsideration
  • how to request an extension of time (if applicable).

The tenant can ask for reconsideration within 21 days of receiving the notice.

The reconsideration will be carried out by a different person from the original decision-maker.

If the application is subsequently found to be compliant, it will be treated as if it had not been rejected.

Copy Sent to Other Party

If the application is accepted, a copy will be sent to the landlord together with:

  • information about the Tribunal process
  • a response form
  • details of how to respond.

The landlord must usually respond within 21 days, unless an extension is granted in exceptional circumstances.

Submission of New Evidence

Any further evidence submitted during the proceedings will normally be shared with the other party.

This ensures that both parties have a fair opportunity to consider and respond before a decision is made.
